Important Information About This Legal Contract
You agree to this User Agreement, and all of its terms and conditions, by visiting, browsing, shopping, accessing or otherwise using the Site. These terms and conditions are subject to change without prior notice at any time, in Planet Market's sole discretion. By visiting, browsing, shopping, accessing or otherwise using the Site after a change has been posted to the Site, the Customer accepts that change. Customers should check this User Agreement and the Privacy Pledge frequently.
This User Agreement is a legal contract between the Customer and Planet Markets. The Customer accepts this User Agreement by making a purchase, placing an order, or otherwise shopping on the Site. (References to "you" or "your" shall relate to the Customer; references to "Planet Markets" shall relate to Planet Markets Shopping Store and its affiliates.) The terms and conditions of this Sale Agreement are subject to change without prior notice, except that the terms and conditions posted on the Site at the time the Customer initially places or modifies an order will govern the order in question.
This User Agreement may only be modified or terminated with regard to goods or services that have been purchased or sold on the Site in a writing signed by Planet Markets. Electronic records (including signatures), that are otherwise valid, shall be accepted under the Sale Agreement. The Customer consents to receiving electronic records, which may be provided via a web browser or e-mail application connected to the Internet; consumers may withdraw consent to receiving electronic records or have the record provided in non-electronic form by contacting Planet Markets at the address provided below.In the event of any conflict between the terms and conditions stated on your purchase order and this User Agreement or any terms and conditions on our invoice, you agree that the provisions of this User Agreement and our invoice shall control.
Access, Interference and Linking
Planet Markets grants you a limited license to access and make personal use of the Site and not to download (other than page caching) or modify it, or any portion of it, except as provided below under "Use Restrictions," or with express written consent of Planet Markets.
The following activity on the Site is expressly prohibited: Any non-personal or commercial use of any robot, spider, other automatic device, or manual process to monitor or copy portions of the Site or the content contained herein without prior written permission by Planet Markets; collection or use of any product listings, descriptions, or prices, from the Site for the benefit of another merchant that supplies products competitive with or comparable to those offered on the Site; and, Any use of, visits to, or other action that imposes an unreasonable or disproportionately large load on the Site, or otherwise interferes with its proper and timely functioning. Any unauthorized use terminates the license granted by Planet Markets.
You are granted a limited, revocable, and nonexclusive right to create a hyperlink to the home page of the Site so long as the link does not portray Planet Markets, its affiliates, or their products or services in a false, misleading, derogatory, or otherwise offensive matter. You may not use any Planet Markets logo or other proprietary graphic or trademark as part of the link without express written permission.

Use Restrictions
The copyright in all material provided on this Site is held by Planet Markets or by the original creator of the material. Except as stated herein, none of the material may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means, including, but not limited to, electronic, mechanical, photocopying, recording, or otherwise, without the prior written permission of Planet Markets or the copyright owner. Permission is granted to display, copy, distribute and download the materials on this Site for personal, non-commercial use only, provided you do not modify the materials and that you retain all copyright and other proprietary notices contained in the materials. This permission terminates automatically if you breach any of these terms or conditions. Upon termination, you must immediately destroy any downloaded or printed materials. You also may not, without Planet Market 's prior written permission, "mirror" any material contained on this Site on any other server. Your Account 

When and if you use the Site, it shall be your sole responsibility to maintain the confidentiality of your e-mail address, password and any other account identifiers related to any personal account you created on the Site (the “Account”), and for restricting access to your computer(s). You also agree to accept sole responsibility for any and all activity that occurs under your Account.

Purchases and Order Status
Purchases on our site are made through the Virtue Mart shopping Cart and a Secure Socket Layer. You can check our SSL Certificate by clicking at the lock in your browser. If you don’t see it, it is because you have chosen to display the non-secure items when you entered check-out. Even so, you will be in a secured environment. If you want to see the SSL Certificate click on No button when the security window opens. All transactions with credit cards,if made through PayPal are protected by the PayPal system. When you pay us directly with your Credit Card, you are paying through the Authorize.Net Gateway and your data is fully protected. After you have made a payment, you will receive an e-mail confirming the transaction. We will send you another e-mail with information about shipping as soon as we process your purchase and the item is ready to ship. If there is a tracking number available, you will receive it as soon as we ship. You will also be able to check your order status through your account. Should there be any delay in shipping, you will be promptly informed.

Payments. Forms of Payment
We accept PayPal, Visa and Mastercard credit cards. We also accept all other forms of payment such as Western Union, Money Orders and Personal Checks. Payments with Western Union and Money Orders have to be pre-arranged and customer should contact us before he can pay us. Western Union and Money Orders have a fee equivalent to the fees for cashing these forms of payment. In all these forms of payment, items will be shipped only after remittance has been received or check has been cleared.

Shipping, Handling and Delivery
We make every effort to ship your order as quickly as possible. Most orders are shipped within 24 to 48 hours from the time we receive your order. Please allow an additional 24 to 48 hours for orders placed over the weekend. We will notify you immediately if any item cannot be shipped within 7 days, at that time you will be given the option to cancel your order. Some locations and extra large orders may require additional shipping charges. If this applies, you will be notified prior to shipping so you can approve the change.

Order Cancellations
You can cancel an order within 3 business days after we have received it.

Return Policy.
Returns will be accepted only in the following cases: 1) You received an item that is not the item you ordered. 2) The item was defective and you don’t accept an exchange.
You must contact us directly before you attempt to return a product to obtain a Return Material Authorization Number for you to include with your return. Items must be returned within 10 days of receiving your RMA. Please mark the RMA number clearly on the outside of your return package. You will be told to what address to ship when you receive the RMA. You must return a Product to us in its original or equivalent packaging and in the same condition it was received.. You are responsible for risk of loss, shipping and handling fees for returning or exchanging product. Some items are not eligible for returns. Please check the individual product's return policy for more information. If the item cannot be returned you will always have the option to exchange it. All return shipping costs are to be paid by the buyer. We strongly recommend that you send your return fully insured, via a traceable shipping method, such as UPS, FedEx, DHL or registered/Express mail. We are not responsible for late, lost, or misdirected packages, nor for products that are damaged during return shipping.

Refunds
We will refund the payment in the following cases:
a) The item has been returned on the basis of our return policy.
b) You paid for the item but it never reached your shipping address and you don't want to wait.
Refunds will be made within the first 30 days of the purchase. After that period, a refund can only be made if the product came with a warranty from the manufacturer and you prefer to return the product instead of having it replaced by another one.

Exchanges
Exchanges will be made for an item of the same kind. Exchanges will be accepted only for the following reasons: 1. Item is defective, either in its appearance or because it cannot be operated. 2. Item is different from what you ordered. 3. Item reached your home in a broken / damaged condition. In all cases shipping expenses for exchanges will be charged to the buyer.

Pricing
Prices offered on the Site are quoted in U.S. Dollars.  Such prices do not include shipping and handling, expedited service, or sales taxes, if applicable, which will be added to your total invoice price.  You are responsible for any shipping and handling charges and state and local sales or use taxes that may apply to your order. 

Items shipped from other warehouses
Since we work with different distributors, some items sold on this site are shipped from warehouses different from Planet Markets' warehouse. In such cases, items may take longer to reach destination. You will be informed if item is shipped from Planet Markets' warehouse or from a distributor's.

Warranty
Warranties for any item if applicable will be stated on a warranty card provided by the manufacturer. These warranties will only be valid if the instructions of the manufacturer are followed by the user

Sales Taxes
All buyers from the state of Texas will be charged the applicable tax as indicated by Texas law.

Limitation Of Liability
To the fullest extent permitted by applicable laws, neither Planet Markets nor any of their respective directors, employees, affiliates or other representatives will be liable for loss or damages arising out of or in connection with the use of, or inability to use, the materials in and/or facilities or services offered through this website, including, but not limited to, indirect or consequential loss or damages, loss of data, income, profit or opportunity, loss of or damage to property and claims of third parties, even if Planet Markets have been advised of the possibility of such loss or damages or such loss or damages were reasonably foreseeable. If this clause is unenforceable in whole or in part in any jurisdiction due to relevant laws, then in no event shall Planet Market's total liability to you for all damages, losses, and claims (whether in contract, tort (including, but not limited to, negligence), or otherwise) exceed the amount paid by you, if any, for accessing this website.

Planet Markets disclaims all representations and warranties, including by way of example but not limitation, as to fitness for a particular purpose, to the fullest extent permitted by applicable laws. In addition, Planet Markets does not represent or warrant that the information and/or facilities accessible via this website are accurate, complete or current, or that this website will be free of defects, including, but not limited to, viruses or other harmful elements. The user of this website assumes all costs arising as a result of the use of this website.

Governing Law and Venue
This Agreement, the entire relationship between you and Planet Markets, and any litigation or other legal proceeding between you and Planet Markets (whether grounded in tort, contract, law or equity) shall be governed by and construed in accordance with the laws of the State of Texas, without giving effect to its choice of law rules. This contract is fully performable in Lamar County, Texas.
